Terms and Conditions

1. Introduction

These Terms and Conditions govern the use of services provided by Web Launch Experts ("we", "our", or "us"). By requesting, purchasing, or using our services, you agree to be bound by these Terms and Conditions.

2. Services

Web Launch Experts provides services including, but not limited to:

  • Website Design and Development
  • E-commerce Website Development
  • Website Hosting
  • Website Maintenance
  • Website Support
  • Related Digital Services

The exact scope of services will be outlined in the quotation, proposal, package details, or agreement provided to the client.

3. Client Responsibilities

The client agrees to:

  • Provide all required content, including text, images, logos, and other materials necessary for the project.
  • Ensure they have the legal right to use all content provided.
  • Review and approve work within reasonable timeframes.
  • Provide accurate and complete information throughout the project.

Delays in providing required information may result in project delays.

4. Project Timelines

Web Launch Experts aims to complete projects within the following typical timeframes:

  • One Page Website: 3–5 business days
  • Five Page Website: 5–10 business days
  • Ten Page Website: 10–15 business days
  • E-commerce Website: 15–30 business days

These delivery targets are provided as estimates and are based on the assumption that all required content, images, product information, and feedback are supplied promptly by the client.

Project timelines may be extended due to:

  • Delays in receiving content or required information.
  • Delays in client feedback, approvals, or revision requests.
  • Requests for additional features or functionality outside the agreed scope.
  • Technical issues or circumstances beyond our reasonable control.

Delivery timeframes will commence once all required project materials have been received and the project deposit has been paid.

Web Launch Experts will make every reasonable effort to complete projects within the estimated timeframe, but does not guarantee specific completion dates unless agreed to in writing.

5. Client Delays

If the client fails to provide required content, feedback, approvals, or information within 14 days of request, the project may be placed on hold.

Projects that remain inactive for more than 30 days may be subject to rescheduling based on current workload and availability.

Web Launch Experts reserves the right to revise the estimated delivery date where delays are caused by the client.

6. Revisions

Each website package includes one revision round after the initial website draft has been presented to the client.

The revision round is intended to address corrections, adjustments, and minor changes to the website content, layout, images, links, and functionality based on the original project scope.

The client will have seven (7) calendar days from the date the website draft is submitted to review the website and provide a complete list of requested revisions.

As part of the review process, the client is responsible for checking and approving, where applicable:

  • Website text and content.
  • Spelling and grammar.
  • Contact information.
  • Business details and addresses.
  • Images.
  • Navigation and menu links.
  • Forms and form submissions.
  • Product information and pricing.
  • E-commerce settings and checkout functionality.
  • Mobile responsiveness.

All revision requests should be submitted together in a single communication where reasonably possible.

Any additional revision requests submitted after the included revision round has been completed may be treated as additional work and charged at the applicable rate.

If no revision requests or feedback are received within seven (7) calendar days, the website shall be deemed approved and ready for launch, and the project may proceed to completion, invoicing, and deployment.

Changes that fall outside the original agreed project scope may require a revised quotation and may affect the estimated project timeline.

7. Payments

Payment terms will be outlined in the quotation, proposal, or invoice provided to the client.

For the Essentials Package, full payment is required before work will commence, and the payment is not refundable.

For all other website packages, a non-refundable deposit of fifty percent (50%) of the total project fee is required before work will commence. The remaining balance shall become due upon project completion and prior to website launch, transfer, or handover.

Monthly and recurring services, including hosting, maintenance, and support plans, must be paid in advance according to the agreed billing cycle.

Failure to make payments by the due date may result in the suspension of services, project delays, or withholding of deliverables until all outstanding amounts have been settled.

The completed website shall remain the property of Web Launch Experts until full payment has been received and cleared.

Ownership rights, website files, website content created by Web Launch Experts, administrative access, website transfer, and deployment to the client's domain shall only be provided once all outstanding balances have been paid in full.

Web Launch Experts reserves the right to withhold website launch, website transfer, access credentials, source files, and ownership rights until all amounts owing have been settled.

The client shall not remove, alter, copy, migrate, or otherwise use any portion of the website prior to full payment being received.

8. Late Payments

All invoices issued by Web Launch Experts are valid for seven (7) calendar days from the date of issue, unless otherwise stated in writing.

Payment must be made within this 7-day period to secure the project timeline, service booking, or hosting allocation.

If payment is not received by the due date stated on the invoice, Web Launch Experts reserves the right to:

  • Suspend any ongoing work on active projects.
  • Pause or delay project timelines.
  • Withhold deliverables until payment has been received in full.
  • Reallocate scheduled resources to other client work.

For hosting services, the client is granted a seven (7) day grace period from the due date to settle outstanding hosting fees.

If hosting payment is not received within the 7-day grace period, the hosting account may be suspended or permanently terminated, and associated website services, emails, and data may become inaccessible.

Reinstatement of suspended hosting services may be subject to a reactivation fee and availability of backups.

Web Launch Experts is not responsible for any loss of data, downtime, or business interruption resulting from suspension or termination due to non-payment.

9. Intellectual Property

Upon full payment, ownership of the completed website design and content developed specifically for the client will transfer to the client.

Web Launch Experts retains ownership of:

  • Development frameworks
  • Templates
  • Proprietary systems
  • Internal tools
  • Reusable code libraries

Unless otherwise agreed in writing.

10. Hosting Services

Where hosting services are provided:

  • Hosting fees are payable monthly or annually in advance.
  • Failure to pay may result in suspension or termination of hosting services.
  • Clients remain responsible for maintaining valid domain registrations.
  • We do not guarantee uninterrupted service but will make reasonable efforts to maintain availability.

11. Domain Names

Where we assist with domain registration:

  • The domain remains the property of the client.
  • Renewal fees remain the responsibility of the client.
  • Failure to renew a domain may result in loss of ownership.

12. Third-Party Services

Web Launch Experts may integrate or make use of third-party services, software, or platforms in the development and operation of client websites. These may include, but are not limited to:

  • Payment gateways
  • WordPress plugins and extensions
  • Hosting providers
  • Analytics tools
  • Marketing platforms
  • Email and communication services

While we take care to recommend reliable tools, Web Launch Experts is not responsible for any interruptions, errors, policy changes, downtime, or service failures caused by third-party providers.

The client acknowledges and agrees that any costs associated with third-party services remain the responsibility of the client. This includes, but is not limited to, subscription fees, renewal fees, licensing fees, and premium upgrades required for plugins, themes, or software used on their website.

Where premium versions of plugins, themes, or software are required for full functionality or enhanced features, the client is responsible for purchasing and maintaining valid licenses unless otherwise agreed in writing.

Failure to maintain valid licenses for third-party tools may result in reduced functionality, security risks, or service disruptions, for which Web Launch Experts shall not be held liable.

13. Website Maintenance and Support

Websites rely on third-party software, plugins, themes, domain providers, and external services that may change over time. While every effort is made to ensure the website is stable and functioning correctly at the time of launch, ongoing maintenance is required to keep the website secure, compatible, and operating as intended.

Unless otherwise agreed in writing, the website design service does not include ongoing maintenance, software updates, plugin updates, theme updates, security monitoring, backups, compatibility testing, content changes, or technical support after the included support period has expired.

The Client acknowledges that future issues may arise as a result of software updates, third-party service changes, security vulnerabilities, or incompatibilities between plugins, themes, and WordPress core software. Such issues are outside the scope of the original website build and may require additional support, maintenance services, or repair work at an additional cost.

Any maintenance or support provided after the included support period may be quoted separately unless the Client is subscribed to an active maintenance plan.

Web Launch Experts is not responsible for issues caused by modifications made by the Client, third parties, or software vendors after website launch.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Web Launch Experts shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services, websites, or deliverables. This includes, without limitation, loss of profits, loss of revenue, loss of business opportunities, loss of data, reputational damage, or business interruption.

Web Launch Experts makes no guarantees that any website, e-commerce store, or digital product will generate specific results, including sales, leads, conversions, traffic growth, or search engine rankings. Any performance outcomes depend on a variety of external factors beyond our control, including but not limited to marketing efforts, market conditions, advertising spend, third-party platforms, and client implementation.

While every effort is made to ensure websites are built with best practices for performance, security, and functionality, Web Launch Experts does not warrant that websites will be free from errors, bugs, vulnerabilities, or uninterrupted availability. Temporary downtime, technical issues, or service interruptions may occur due to hosting providers, plugins, software updates, or other third-party systems.

Web Launch Experts shall not be responsible for any loss, corruption, or recovery of data, including website content, customer information, or backups, except where explicitly stated under a separate maintenance or hosting agreement.

The client assumes full responsibility for all content, materials, and instructions provided to Web Launch Experts. This includes ensuring that all content is legally owned or licensed and does not infringe on any third-party rights. Web Launch Experts shall not be liable for any legal claims, disputes, or damages arising from client-supplied content.

In no event shall the total liability of Web Launch Experts, whether in contract, delict (tort), negligence, or otherwise, exceed the total amount paid by the client for the specific service giving rise to the claim.

Any claims or disputes must be submitted in writing within a reasonable period after the issue arises. Failure to do so may result in the claim being considered invalid.

Web Launch Experts shall not be held liable for issues arising from third-party services, including hosting providers, domain registrars, plugin developers, payment gateways, or external integrations, even if these services were recommended or configured during the project.

The client acknowledges that they are responsible for maintaining backups of their website unless a separate backup or maintenance service has been explicitly agreed upon.

15. Termination

Either party may terminate a project or service agreement by providing written notice. Termination requests must clearly state the reason for cancellation and will only be considered valid once acknowledged in writing by Web Launch Experts. In the event of termination by the client, all work completed up to the date of termination will be invoiced and becomes immediately payable, regardless of project completion status.

Upon termination, any access to websites, hosting services, development environments, or related systems may be suspended or revoked. Deposits paid are non-refundable, as they secure project time, resources, and scheduling. Web Launch Experts reserves the right to retain all work-in-progress until outstanding balances are settled in full. Any materials, files, or deliverables will only be released once all financial obligations have been met.

16. Refund Policy

Due to the nature of digital services:

  • Deposits are non-refundable.
  • Completed work is non-refundable.
  • Refund requests will be assessed at our sole discretion where applicable.
  • All payments follow agreed project scope

17. Portfolio Rights

Unless otherwise agreed in writing, Web Launch Experts reserves the right to display completed projects in its portfolio, marketing materials, and promotional content.

18. Privacy

Any personal information collected will be handled in accordance with our Privacy Policy and applicable South African data protection laws, including POPIA.

19. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time.

Updated versions will be published on our website and become effective upon publication.

20. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
